Adoption and surrogacy assistance

There are many paths to parenthood, and Microsoft is committed to supporting you in your journey to grow your family. This program is designed to help cover some of the costs associated with adoption, surrogacy, and embryo donation.

You’ll need to submit reimbursement requests within six months of when you paid the expense. You can start claiming reimbursements while still in the process of adopting or using surrogacy. You don't have to wait until everything is final to start submitting receipts.

Anything you spent before getting hired, after termination, or while ineligible can't be reimbursed. You must be an active eligible employee both when you incurred the expense as well as when the reimbursement is paid out. Processing can take 1-2 pay periods, so be sure to submit claims at least 15 days prior to changing to an ineligible status. 

Note: Reimbursements from this program are treated as taxable income and will be reported on your Form W-2 for the year they are issued. To alleviate the tax impact, Microsoft will increase the reimbursement to cover withholding taxes. This adjustment will appear on your paystub when the reimbursement is distributed and may influence your total taxable income. Microsoft does not offer tax advice. You’re eligible for this program if you’re an active Microsoft employee on the US payroll. Interns and visiting researchers are not eligible for this benefit. Qualifying adoptions of children under age 18 include: 

  • Domestic or international children 

  • Stepchildren 

  • Foster children 

  • Grandchildren 

  • Second parent adoption by an employee 

Eligible expenses for adoptions or surrogacies currently in progress can be reimbursed up to $10,000 per child. The lifetime maximum per household is $30,000, even if both partners work at Microsoft.

Note :  Covered expenses you incur that don’t result in a successful live birth are still eligible for reimbursement under this program, limited to $10,000 for each attempt, up to the lifetime maximum per household of $30,000.

Eligible adoption expenses

  • Public and private agency fees 
  • Court costs and legal fees 
  • Travel expenses 
  • Temporary foster care fees/expenses (after the adoption process has begun) 
  • Foreign adoption fees 
  • Pre-adoption medical examination (this covers any treatment, including dental and vision) 
  • Out of pocket maternity fees (medical expenses for the child's birth mother, who cannot be a Microsoft employee or spouse) 

Eligible surrogacy expenses

  • Surrogacy agency or legal fees 
  • Attorney fees for both intended parents and surrogate 
  • Psych screening and home visit fees for surrogate 
  • Psych screening and home visit fees for intended parent(s) 
  • Court fees 
  • Surrogate compensation 
  • Surrogate escrow funds 
  • Fees associated with the adoption of a child through a legally recognized surrogate arrangement 
  • Medical expenses related to a surrogate's pregnancy (which may include but are not limited to cost-sharing expenses under surrogate's maternity insurance, such as surrogate's deductible, co-insurance, or co-payments. Cannot be a Microsoft Employee or Spouse) 
  • Travel expenses for the intended parents or surrogate related to the surrogacy  
  • Consultant/specialist fees 
  • Any other surrogacy-related expenses that Microsoft deems to be reasonable and customary

Eligible embryo donation expenses

  • Fertility clinic treatment fees 
  • Donor agency, psych screening, and/or legal fees 
  • Donor contract fees 
  • Donor compensation 
  • Donor medication 
  • Fees associated with the purchase of fresh or already frozen donor tissue 
  • Egg or sperm donor screening costs 
  • Egg or sperm retrieval fees 
  • Egg or sperm shipping and transport fees 
  • Egg or sperm storage fees 
  • Travel expenses for the intended parents or surrogate related to donor services 
  • Embryo donations fees including but not limited to admin, legal, and psych screening fees 
  • Consultant/specialist fees 

Ineligible expenses

  • Any circumstances where the Microsoft employee is not the intended parent  
  • Clothing & Food 
  • Moving Costs 
  • Living Expenses of the birth mother during pregnancy 
  • Expenses already paid for or reimbursed by another employer, benefit program, or party (e.g., Progyny, Health Plus Plan, health plan copays/deductibles/coinsurance, expenses/equipment eligible under health plan/HSA/FSA) 
  • Expenses incurred that are in violation, or due to violation of applicable laws 
  • Donation arrangements that are not legally recognized 
  • Costs covered under a government program 
  • Medical expenses related to an intended parent's (Microsoft employee) pregnancy - (must be billed to medical insurance instead) 
  • Any services or items that have been prescribed for a medical reason, as that would be considered excluded medical care. Additionally, any qualified medical expenses that are covered or reimbursable under your health plan, health or dental/vision FSA, or HSA are not eligible for reimbursement

To get started with your reimbursement request: 

Submit a claim

Go to Forma and click "File a Claim" for adoption/surrogacy/embryo donation reimbursement. 

Provide documentation

Upload receipts of eligible expenses incurred within six months of the expense date and a copy of the proof of eligibility (e.g., a court-approved adoption decree, a letter from an attorney, medical clinic, donor agency, or an adoption agency). 

Agree to the Terms and Conditions

“I have reviewed the following guidelines for the Adoption Assistance program, including the program limits (e.g. maximum amount and lifetime maximum per Microsoft household). Employees must exhaust any locally available financial or other assistance available before claiming this Microsoft benefit. For example, this would cover adoption assistance available under a health or social insurance plan/system or a national health plan/service. The documentation provided for reimbursement will be true, accurate, and complete to the employee's knowledge. Providing false, inaccurate, or incomplete information or omitting facts, may result in denial of reimbursement and disciplinary action, up to termination of employment, at Microsoft's discretion.” 

Quick tip! To check the status of your reimbursement, go to Forma and click "Claims" to see if your request is approved, pending, or declined.

After your request is approved, you’ll receive the reimbursement payment in your paycheck. It can take up to two pay periods for the funds to appear depending on the date you submit a request and the date it's approved.
